Anyone who makes a purchase through the site is referred to as the “BUYER.”
ARTICLE 2 – SUBJECT OF THE AGREEMENT
The subject of this agreement is to determine the rights and obligations of the parties in accordance with the provisions of the “Consumer Protection Law” regulations of the UK Republic of Northern Cyprus (TRNC) concerning the sale and delivery of the goods/services, which the BUYER orders electronically or via phone from the SELLER’s website www.roidwp.com, with the specifications and sales price mentioned in the contract. The BUYER acknowledges and declares that they are aware of all preliminary information about the goods/services for sale, including their essential characteristics, sales price, payment method, and delivery conditions, as well as their right of withdrawal, and confirms this electronically before placing an order. The preliminary information and invoice provided on the payment page of www.roidwp.com are integral parts of this agreement.
ARTICLE 3 – DATE OF AGREEMENT
This agreement, previously signed by the SELLER in two copies, is deemed accepted and signed by the BUYER on the date of purchase and payment.
ARTICLE 4 – DELIVERY OF GOODS/SERVICES, PLACE OF PERFORMANCE, AND DELIVERY METHOD
The goods/services will be delivered to the electronic mail account or, depending on the product, the physical address specified by the BUYER.
ARTICLE 5 – DELIVERY COSTS AND PERFORMANCE
The delivery costs are borne by the BUYER. If the SELLER has declared on the website that it will cover the delivery fee for purchases above a certain amount, the delivery costs will be borne by the SELLER. Delivery is made as soon as possible after the product is in stock and the payment has been received by the SELLER. The SELLER shall deliver the goods/services within 30 (thirty) days of the order, reserving the right to extend this period by an additional 10 (ten) days with written notice. If, for any reason, the goods/services are not paid for or the payment is canceled by the bank, the SELLER is released from its obligation to deliver the goods/services.
ARTICLE 6 – BUYER’S DECLARATIONS AND COMMITMENTS
The BUYER shall inspect the goods/services before accepting delivery and shall not accept defective, damaged, or improperly packaged goods/services from the courier company. If the goods/services are received, they shall be deemed to be in good condition and intact. After delivery, the BUYER is responsible for keeping the goods/services secure. The invoice must be returned in case of returns. If the goods/services are delivered and later determined to be subject to unauthorized use of the BUYER’s credit card, leading the relevant bank or financial institution not to pay the SELLER, the BUYER is required to return the goods/services to the SELLER within 3 (three) days. In this case, the delivery costs shall be borne by the BUYER.
ARTICLE 7 – SELLER’S DECLARATIONS AND COMMITMENTS
The SELLER is responsible for delivering the goods/services intact, complete, in accordance with the specifications stated in the order, and with the necessary documentation such as warranty certificates and user manuals if applicable. If the goods/services are to be delivered to a third party/entity other than the BUYER, the SELLER is not responsible if the third party refuses to accept the delivery. Upon receiving the withdrawal declaration, the SELLER shall refund the amount paid within 7 (seven) days and accept the return of the goods/services within 20 (twenty) days. If the SELLER deems the performance of the contract impossible before the deadline, they shall notify the BUYER. In such a case, the paid amount and any accompanying documents shall be refunded within 10 (ten) days. If the goods/services sold with or without a warranty certificate are defective or faulty, they may be sent to the SELLER for necessary repairs under warranty conditions, in which case the delivery costs shall be covered by the SELLER.
ARTICLE 8 – FEATURES OF THE GOODS/SERVICES SUBJECT TO THE AGREEMENT
The type, quantity, brand/model, color, and total price, including all taxes, of the goods/services are specified on the product description page on www.roidwp.com and in the invoice, which is an integral part of this agreement.
ARTICLE 9 – CASH PRICE OF GOODS/SERVICES
The cash price of the goods/services is available in the sample invoice sent via email after the order and in the invoice delivered to the customer along with the product.
ARTICLE 10 – INSTALLMENT PRICE
The installment price of the goods/services, based on the payment plan chosen by the BUYER, is detailed in the sample invoice sent via email and the invoice provided with the product.
ARTICLE 11 – DOWN PAYMENT AMOUNT
The down payment amount of the goods/services is available in the sample invoice sent via email after the order and in the invoice delivered to the customer along with the product.
ARTICLE 12 – PAYMENT PLAN
If the BUYER purchases with a credit card and chooses installment payments, the selected installment plan applies. The terms of the installment payments are subject to the agreement between the BUYER and their bank.
ARTICLE 13 – RIGHT OF WITHDRAWAL
The BUYER has the right to withdraw from this contract within 7 (seven) days of receiving the goods/services. To exercise this right, the BUYER must notify the SELLER via email (info@roidwp.com) within the same period. The goods/services must be returned intact, without damage, as stipulated in Article 14 of this agreement. Upon receipt of the withdrawal notice, the payment shall be refunded within 10 (ten) days, and the return shall be completed within 20 (twenty) days. The return shipping cost shall be covered by the SELLER.
ARTICLE 14 – GOODS/SERVICES EXCLUDED FROM THE RIGHT OF WITHDRAWAL
Non-refundable goods/services include perishable items, single-use goods, software, digital licenses, and programs. Additionally, for software, DVDs, CDs, MDs, and computer supplies, the right of withdrawal is only valid if the packaging is unopened and unused.
ARTICLE 15 – DEFAULT AND LEGAL CONSEQUENCES
If the BUYER defaults on credit card transactions, they will be responsible for paying interest and associated legal fees per their bank’s credit card agreement. In such cases, the SELLER may seek legal remedies.
ARTICLE 16 – COMPETENT COURTS
U.K. courts and enforcement offices shall have jurisdiction over disputes arising from this agreement.
